These Terms of Service (“Terms”) govern your access to and use of the Appraisly platform, website, and related services (collectively, the “Service”), operated by Appraisly (“Appraisly,” “we,” “our,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Appraisly provides software tools designed to assist insurance professionals and related users with document analysis, narrative generation, and estimate comparison workflows. The Service is provided on a self-service basis and does not replace professional judgment, appraisal expertise, or legal advice.
2. Eligibility and Accounts
You must be at least 18 years old and capable of entering into a binding agreement to use the Service. You are responsible for maintaining the confidentiality of your account credentials, all activity that occurs under your account, and ensuring that information you provide is accurate and current.
3. User Content and Uploaded Files
3.1 Ownership. You retain all rights, title, and interest in files and data you upload (“User Content”). By uploading User Content, you grant Appraisly a limited, non-exclusive, revocable license to process, store, and display such content solely for the purpose of providing the Service.
3.2 Responsibility. You represent and warrant that you have the legal right to upload and process the User Content, your use of the Service does not violate any laws, contracts, or third-party rights, and you are not uploading content you are not authorized to use.
4. File Processing and Limitations
Appraisly processes files only as requested by the user. Appraisly does not attempt to decrypt, bypass, or defeat proprietary file protections. Certain file formats may be unsupported or partially supported. Appraisly does not guarantee successful processing of every file. You acknowledge that outputs are dependent on the quality, completeness, and format of the uploaded materials.
5. Generated Outputs and Use
Generated narratives, summaries, and comparisons are automatically produced based on user inputs and provided for informational and workflow assistance purposes only. You are solely responsible for reviewing, validating, and approving all outputs before use in any professional, legal, or financial context.
6. Data Retention and Deletion
Appraisly retains uploaded files and generated outputs for up to 30 days by default, unless retained longer at the user's direction or as required for service functionality. Users may delete files and data at any time. Deletions are permanent within a commercially reasonable timeframe.
7. Security
Appraisly implements industry-standard technical and organizational safeguards, including encryption in transit and at rest, access controls, and audit logging. Appraisly is not currently SOC 2 certified but follows SOC-2-aligned security practices.
8. Fees and Subscriptions
Certain features of the Service may require payment. Fees are disclosed prior to purchase. Subscription fees are billed in advance. Payments are non-refundable except as required by law or explicitly stated. Appraisly reserves the right to modify pricing with reasonable notice.
9. Prohibited Use
You agree not to use the Service for unlawful purposes, upload malicious code or attempt to disrupt the Service, reverse engineer or decompile the Service, circumvent security or access controls, or use the Service to infringe intellectual property rights.
10. Intellectual Property
The Service, including its software, design, branding, and proprietary logic, is owned by Appraisly and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service itself.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” APPRAISLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. APPRAISLY DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT OUTPUTS WILL BE COMPLETE OR ACCURATE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: APPRAISLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. APPRAISLY'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO APPRAISLY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Appraisly from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
14. Termination
Appraisly may suspend or terminate access to the Service if you violate these Terms or misuse the Service. Upon termination, your right to use the Service will immediately cease.
15. Modifications
Appraisly may modify the Service or these Terms at any time. Material changes will be reflected by an updated “Last Updated” date. Continued use constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.

Payment Terms & Billing Policy

This Payment Terms & Billing Policy governs subscription plans, credit usage, billing practices, and payment obligations for Appraisly. By subscribing to or purchasing services from Appraisly, you agree to the terms below.
1. Subscription Plans & Pricing
Appraisly offers the following subscription tiers:
- Solo Plan — $79/month: Includes 2 credits per billing cycle.
- Pro Plan — $149/month: Includes 5 credits per billing cycle.
- Elite Plan — $249/month: Includes 12 credits per billing cycle, priority processing, and early feature access.
- Enterprise Plan — $349+/month: Custom pricing and usage limits determined by written agreement.
- Per-File Purchase — $39 per file: Non-refundable once processing begins.
All pricing is listed in U.S. Dollars and may be modified with advance notice.
2. Credit Usage
One (1) credit is consumed per narrative or eligible processing event. Credits apply to narrative generation and related processing unless otherwise specified. Credits are allocated monthly based on subscription tier. Credits have no cash value and are not redeemable for currency.
3. 30-Day Grace Rollover
Unused credits roll over for one additional billing cycle only. Unused credits from Month 1 may be used during Month 2. At the end of Month 2, any remaining rolled-over credits expire. Credits may not accumulate beyond two billing cycles. Rollover credits expire automatically and cannot be reinstated.
4. No Credit Buybacks or Cash Redemption
Credits cannot be refunded for cash, converted into monetary value, transferred between accounts, or sold or assigned. Appraisly does not offer credit buybacks under any circumstances.
5. Billing Cycle & Auto-Renewal
Subscriptions are billed monthly on the original subscription date and renew automatically unless canceled prior to the next billing date. Failure to process payment may result in suspension of account access, loss of unused credits, and termination of services.
6. Downgrades & Plan Changes
Users may downgrade their subscription at any time. Downgrades take effect at the next billing cycle. Unused credits beyond the limits of the downgraded plan may be forfeited.
7. Winter Mode
Appraisly may offer a limited “Winter Mode” subscription adjustment at its discretion. Winter Mode is intended for seasonal slow periods, may reduce billing while preserving account access, does not preserve unlimited credit rollover, and is subject to eligibility requirements. Winter Mode terms may be modified or discontinued at any time.
8. Refund Policy
Due to the digital and automated nature of the service: subscription fees are non-refundable once billed, processed credits are non-refundable, partially used billing cycles are not prorated, and per-file purchases are non-refundable once processing begins. Exceptions may be granted solely at Appraisly's discretion.
9. Price Changes
Appraisly reserves the right to modify subscription pricing with advance notice. Existing subscribers may be grandfathered at prior pricing at Appraisly's sole discretion.
10. Taxes
Users are responsible for any applicable sales taxes, VAT, or other government-imposed fees required in their jurisdiction.
11. Chargebacks & Payment Disputes
Initiating a chargeback without first contacting Appraisly support may result in immediate account suspension, permanent account termination, and loss of remaining credits. Users agree to contact Appraisly to resolve billing concerns before initiating payment disputes.
12. Limitation of Financial Liability
To the maximum extent permitted by law, Appraisly's total liability related to billing disputes or service availability shall not exceed the total subscription fees paid by the user in the preceding twelve (12) months. Appraisly is not liable for lost profits, business interruption, missed claim deadlines, regulatory penalties, or indirect or consequential damages.

This Privacy Policy describes how Appraisly (“Appraisly,” “we,” “our,” or “us”) collects, uses, stores, and protects information when you access or use the Appraisly platform, website, and related services (collectively, the “Service”).
By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.
1. Information We Collect
1.1 Information You Provide. We collect information that you voluntarily provide, including name, email address, and account details; uploaded files (e.g., PDFs, spreadsheets, estimate documents); content generated within the Service (e.g., narratives, summaries, comparisons); and communications with Appraisly support.
1.2 Automatically Collected Information. We may automatically collect limited technical information, such as IP address, browser type and device information, usage timestamps and interaction metadata, and log data necessary for security, performance, and reliability.
2. How We Use Information
We use collected information solely to provide and operate the Service, process user-requested file uploads and outputs, improve performance and reliability, maintain security and audit logs, and communicate with users regarding their account or service updates. We do not sell user data and do not use uploaded files for advertising, marketing, or training third-party models.
3. File Processing and Data Retention
3.1 File Processing. Files uploaded to Appraisly are processed only for the purpose explicitly requested by the user. Appraisly does not attempt to decrypt, reverse-engineer, or bypass proprietary file protections.
3.2 Data Retention. Uploaded files and generated outputs are retained for up to 30 days by default. Users may delete files and outputs at any time. Deleted files are permanently removed from active systems within a commercially reasonable timeframe. Retention periods may be adjusted to comply with legal, regulatory, or operational requirements.
4. Data Security
Appraisly implements industry-standard safeguards including encrypted connections (TLS/HTTPS) for data in transit, secure cloud infrastructure with encryption at rest, restricted internal access based on least-privilege principles, segregation of production and development environments, and logging and monitoring of critical system activity.
5. Access Controls and Confidentiality
User data is accessible only to authorized Appraisly systems and personnel as necessary to operate and maintain the Service. Internal access is restricted, logged, and reviewed periodically.
6. Third-Party Services
Appraisly may rely on third-party infrastructure providers (e.g., cloud hosting, storage, authentication) solely to deliver the Service. These providers are contractually obligated to maintain appropriate security and confidentiality protections.
7. Compliance and Certifications
Appraisly is not currently SOC 2 certified. However, Appraisly follows SOC-2-aligned security and operational best practices and will pursue formal certification if required by enterprise customers or regulatory obligations.
8. User Rights and Control
Users retain ownership of their data and may access and export generated outputs, delete uploaded files and account data, and request full account deletion by contacting support.
9. Changes to This Policy
We may update this Privacy Policy from time to time. Updates will be reflected by a revised “Last Updated” date. Continued use of the Service after changes constitutes acceptance of the updated policy.

Appraisly does not provide legal advice, engineering opinions, claim settlement authority, insurance coverage determinations, or regulatory compliance guidance. All outputs generated by the platform are drafts intended for professional review. Users remain solely responsible for all final claim decisions, written communications, scope conclusions, valuation determinations, and regulatory compliance obligations.
2. AI-Generated Content Limitations
Appraisly relies on automated document parsing, OCR systems, and machine learning models that may misread or misclassify line items, omit relevant estimate details, misinterpret quantities, measurements, or scope notes, or generate incomplete or inaccurate narrative language. Accuracy is not guaranteed. Users must independently verify all data, figures, and conclusions prior to submission, publication, or professional reliance.
3. User Responsibility
By using Appraisly, you acknowledge and agree that you are a licensed or authorized professional responsible for your own work product; you will review all AI-generated output before use; you will not rely solely on automated outputs to make claim, legal, or financial decisions; and Appraisly is a drafting and workflow assistance tool only.
4. Limitation of Liability
To the maximum extent permitted by law, Appraisly, its owners, affiliates, contractors, and agents shall not be liable for errors or omissions in generated content, claim payment disputes, regulatory complaints, professional discipline, financial losses, or legal actions arising from reliance on platform outputs. Use of the platform is at your own risk.
5. Misuse and Misconduct
Appraisly may not be used for fraudulent, misleading, unlawful, or unethical claim practices. The user assumes full responsibility for any misuse of the system.

1. Scope of Data Processed
Appraisly processes only data voluntarily submitted or generated within the platform. This may include user account information (name, email, organization, billing details), claim and document data (PDFs, XLSX, scope notes, denial letters, policy excerpts, claim numbers, dates of loss, property addresses, insured names), generated content (AI-generated narratives, comparison summaries, extracted line-item data), and technical and usage metadata (timestamps, upload and processing logs, feature usage activity, system diagnostics). Appraisly does not intentionally collect sensitive personal data beyond what users voluntarily upload.
2. Purpose of Data Processing
Uploaded data is processed solely for extracting structured estimate information, generating AI-assisted narratives, comparing carrier and demand estimates, organizing claim documentation, and providing workflow functionality. Appraisly does not make claim payment decisions, determine coverage, provide underwriting decisions, act as a licensed adjuster or legal advisor. All professional decisions remain the sole responsibility of the user.
3. AI, OCR & Automated Processing
Appraisly utilizes automated systems including OCR, document parsing engines, machine learning models, and cloud-based AI processing providers. Document content may be temporarily processed by secure third-party AI services to extract structured data and generate outputs. No automated system guarantees 100% accuracy. Outputs may contain errors, omissions, or misinterpretations. Users are solely responsible for reviewing and verifying all extracted data and generated content before professional use.
4. What Appraisly Does NOT Do
Appraisly does not sell user-uploaded data, share files for advertising purposes, scrape or ingest data without user action, attempt to decrypt or bypass proprietary file protections, resell or license claim data, or mine user claim data for commercial resale. User documents remain user-controlled.
5. Data Ownership
Users retain ownership of all uploaded documents and generated outputs. Appraisly claims no ownership interest in user content. By uploading content, users grant Appraisly a limited license to process the data solely for providing platform functionality.
6. Data Storage & Retention
Files are stored in secure, encrypted cloud infrastructure. Extracted data may be stored in structured databases. Users may delete projects and files at any time. Deleted files are removed from active systems. Backup copies may be retained for a limited period for disaster recovery and compliance purposes. Appraisly may retain limited records for fraud prevention, billing disputes, or legal compliance. Appraisly does not retain files longer than reasonably necessary to provide the service.
7. Security Measures
Appraisly implements commercially reasonable safeguards including HTTPS/TLS encryption for all data in transit, encryption at rest for stored files and databases, secure cloud infrastructure, role-based access controls, restricted production system access, separation of development and production environments, audit logging for uploads, processing, and deletions, and secure credential management and rotation. While we follow industry-aligned best practices, no system can guarantee absolute security. Users upload and process data at their own risk.
8. Access Controls
Only authorized Appraisly systems can access user data. Internal access is limited to personnel or systems necessary to maintain service reliability. Access is restricted based on operational necessity. Administrative actions are logged.
9. Third-Party Service Providers
Appraisly may use trusted third-party providers for cloud hosting, database storage, AI processing, and payment processing. These providers may temporarily process data solely to deliver platform functionality. Appraisly is not responsible for independent acts or omissions of third-party service providers beyond commercially reasonable vendor selection.
10. Regulatory Position
Appraisly is not a licensed adjusting firm, legal services provider, engineering firm, compliance auditing system, or SOC 2 certified. Appraisly follows SOC-2-aligned best practices but does not currently maintain formal certification. Users remain fully responsible for compliance with state insurance regulations, professional licensing rules, and privacy laws applicable to claim handling.
11. User Responsibilities
Users are responsible for uploading only documents they are authorized to use, complying with all applicable privacy and insurance regulations, reviewing all AI-generated content prior to submission, protecting account credentials, and maintaining proper claim handling practices. Appraisly is not liable for misuse, professional misconduct, regulatory violations, or improper reliance on automated outputs.
12. Limitation of Liability
To the maximum extent permitted by law, Appraisly shall not be liable for data loss, unauthorized access, AI-generated inaccuracies, claim payment disputes, regulatory complaints, professional discipline, or financial losses arising from reliance on platform outputs. Use of the platform is at your own risk.
13. User Control & Deletion Rights
